Products Purchased from the Site

All items purchased from the Site are made pursuant to a shipment contract that includes terms and conditions in addition to those herein. The risk of loss and title to said items passes to you upon our deposit of the merchandise into the mail or upon delivery to the carrier service. You are responsible for reading and complying with such contracts.

Runnings attempts to ensure that product descriptions are as accurate as possible. However, Runnings does not warrant that product descriptions or other content of this Site is accurate, complete, reliable, current, or error-free. Certain weights are approximate and are provided for convenience purposes only. Please note that because the colors you see depend on your monitor, Runnings cannot guarantee that your monitor will display the exact color of an item. If a product offered on the Site is not described accurately, your sole remedy is to return it in an unused condition for a refund, minus shipping and handling expenses.

Runnings reserves the right to: (i) discontinue the sale of a product listed on the Site at any time without notice; and (ii) correct any errors or inaccuracies and to change or update information at any time without prior notice.

By making a purchase from the Site, you authorize Runnings to share certain personal information with its strategic partners in order to process your payment, and you further acknowledge and agree that Runnings is not responsible for any act or omission of those strategic partners with respect to your personal information.

Limitations on Quantity

Runnings does not offer additional discounts on large orders of a single item or on large orders of many individual items. Additionally, we reserve the right to limit quantities on orders placed by the same account, on orders placed by the same credit card, and on orders that use the same billing or shipping address. We will notify you if such limits are applied.

Runnings makes no guarantee that the products or services advertised or offered on the Site will be available at all times. If an item is specifically marked “Low Inventory,” we cannot warranty that enough products will be available to fulfill your order. In this situation, the purchase price of these items will be immediately refunded.

Disclaimer of Warranties

This site, the Runnings materials, and the services herein are provided by Runnings on an "as is" and "as available" basis. Limitation of Liability

Runnings will also not be liable for damages of any kind, whether actual, punitive, incidental or consequential, arising out of or in connection with this site, the Runnings materials, or any content on or accessed through this site or any site linked to, or any copying, displaying or use thereof, the unavailability of this site, damage to your computer, or any loss of data or business interruption resulting from the use of this site, whether or not such damages are foreseeable or in contemplation of the parties, even if Runnings has been advised of the possibility of such damages, without regard to the form of action and whether in contract, tort, negligence, strict liability, or otherwise.

If you are dissatisfied with any portion of this site, or the products, programs or services offered in this site or with any of these terms, your sole and exclusive remedy is to discontinue using the site and any products, services or programs provided through this site.

The negation of damages set forth above are fundamental elements of the basis of the bargain between you and Runnings.  The site and the information would not be provided without such limitations.  No advice or information, whether oral or written, obtained by you from us through the site shall create any warranty, representation or guarantee not expressly stated in this agreement.

Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions, or limitations may not apply to you, and you might have additional rights.

AG USE AND TAX POLICY
Some organizations, businesses, and agricultural producers may be exempt from sales tax on certain items. At this time we do not offer tax exempt purchases online. However, we are happy to offer such eligible purchases to you in any of our store locations. To make tax exempt purchases in our stores, you must have a tax exempt account with Runnings, along with a signed Certificate of Exemption on file. You can check with your state department of revenue for requirements and regulations regarding tax exempt purchases in your state. For your convenience, the following links have been provided for ease of use:

• Minnesota Certificate of Exemption: http://www.revenue.state.mn.us/Forms_and_Instructions/st3.pdf
• South Dakota Certificate of Exemption: http://dor.sd.gov/Taxes/Business_Taxes/Publications/PDFs/exemption_certificate0713.pdf
• North Dakota Certificate of Exemption: http://www.nd.gov/tax/salesanduse/streamlinetax/streamlinedcertificateofexemption.pdf?20150202091106
• Montana Certificate of Exemption: Because there is no general sales tax in Montana, the state does not provide Exemption Certificates or sales tax exemption numbers. It is recommended that you use a number that is unique to your business, which could include either a Social Security Number (SSN) or Federal Identification Number (FEIN). For more information, visit https://revenue.mt.gov/
• New York: New York currently requires a Certificate of Exemption in order to make tax-free purchases. To access a list of exemption certificates and guidelines, visit http://www.tax.ny.gov/pdf/tg_bulletins/sales/b10_240s.pdf.
• New Hampshire: New Hampshire does not currently require a physical certificate of exemption upon purchase of goods, as it does not have a general sales and use tax. Should any entity require confirmation that New Hampshire does not issue Exemption Certificates, please visit the following address and print out the page: http://www.revenue.nh.gov/assistance/resale-exempt-certs.htm
